What is a registered agent?
A registered agent acts as an
intermediary between Australian Securities and Investments Commission (ASIC) and Australian companies, to help companies meet
their lodgement obligations under the Corporations Act 2001 (Corporations Act). A registered agent does not operate on ASIC’s behalf but instead operates on behalf of companies who need to lodge information with ASIC.
A registered agent:
- frequently lodges documents with ASIC, electronically
- represents multiple companies by maintaining the CoRporate Registers in line with the Corporations Act 2001
- ensures Company Directors meet their annual ASIC obligations including payment of the ASIC Annual Review fee and reviewing company details held with ASIC
- advises Company Directors of any Corporate Compliance updates
Rubiix Business Accountants are able to lodge information on behalf of companies electronically with ASIC, using the “EDGE” electronic document lodgement system (which requires third party software to lodge).
Who can be a registered agent?
The role of a registered agent is an important one. A registered agent must meet the registration criteria and ASIC’s expectations of agent conduct to maintain registration.
Many accountancy and legal firms are registered with ASIC as agents. Registered agents are usually members of specific Industry Associations that recognise the qualifications of these individuals and firms. Often, as in the case with Rubiix, a registered agent will also be a Tax Agent, lodging documents on behalf of businesses and companies with the Australian Tax Office (ATO).
